The laws concerning ATV’s, UTV’s and, unfortunately fall into several areas of the Transportation Code. Anything with a “saddle” style seat, ATV is not allowed to operate on any public roadway or beach. The UTV’s side by side seat, were allowed, until recently. the law depending on what definition was used or interpreted allowerd the ATV’s to be operated by a licensed driver.
With multiple statutes and interpretations the District Attorney’s was contacted for a ruling. The only motorized vehicle allowed on the beach, with certain restrictions is a golf cart, other than a motor vehicle that is registered,inspected and insured as if it was being operated on any highway in the state.
